This Terms of Service Agreement states the terms and conditions governing the use of the services and materials of Rent Hosting. All prices are stated in United States Dollars (USD). By submitting the order form below, or by using Rent Hosting's service, the client agrees to abide by the terms and conditions outlined below.

Rent Hosting reserves the right to amend or change this Terms of Service Agreement at any time with due notice provided to the client. This document was last updated on: July 25, 2007.

This document contains the Acceptable Use Policy (AUP), Privacy Policy and the Billing Policy as part of its terms.

1. Money Back Guarantee. Our clients have a 30 day money back guarantee. If for any reason the client is unsatisfied with the services of Rent Hosting with the first 30 days of purchase, the company will refund the client's money. The amount refunded will be the dollar amount paid to Rent Hosting, less the bandwidth used with-in the first 30 days of service. Please refer the refunds and account cancellations sections for more information.

2. 99.9% Uptime Service Level Agreement (SLA). Should Rent Hosting fail to reach a monthly 99.9% uptime, a partial or complete refund, as determined by the extent of the situation, will be granted upon receipt of the customer's request. Refunds are given when a service crucial to the operation of the website, or a combination of the said services are not available for 99.9% of the month. Between 99.9 and 99.8 at least a 30% refund is issued; between 99.8 and 99.7 at least a 50% refund is issued and a full refund would be provided for any downtime amount below. The company's monitoring logs are provided upon request. The above policy does not apply to scheduled downtime when customers are notified in advance.

3. Refunds. The client may cancel his/her hosting account at any time. After the first 30 days of service, refunds will be granted for full unused months. Domain name, SSL certificate, and ClientExec purchases are non-refundable; should the client receive a free domain during a promotion, upon early cancellation, the client will be charged a $10 fee and must transfer the domain away from Rent Hosting with-in a period of one month. If after a month, the client does not transfer the domain name, Rent Hosting cannot be held liable for the domain. No refunds will be issued if any part of this agreement is breached; the company's money back policy is also void in this instance.

4. Account Information / Verification. To protect our customers, Rent Hosting will log and verify that the IP of an account holder matches the country he/she indicates on the order form. If the company is unable to confirm the above, Rent Hosting reserves the right to call the account holder's phone number in order to verify that he/she did indeed order the services of Rent Hosting, or to take any other action necessary to verify the validity of the order. Should Rent Hosting determine that information provided by the customer during the sign-up process is invalid, the company reserves the right to terminate or suspend the offending account. The client is responsible for updating his/her contact information.

5. Account Termination. The client may cancel his/her hosting account at any time. All account termination requests must be sent to cancellations@rent-hosting.com. The content of this email must specify the domain name used by the client during the ordering process and order number included in the welcome email. Note that by emailing Rent Hosting the client is requesting an immediate termination of his/her account. Should the client have purchased a domain with Rent Hosting, he/she will need to transfer it away from us with-in a period of one month. Please allow up to a week for Rent Hosting to cancel an account after a request has been submitted. Rent Hosting reserves the right to hold the refund, if any is due, and account termination until we have verified that the cancellation is by the real owner of the account. If the client purchases a ClientExec licence with Rent Hosting, after account cancellation, he/her will no longer have access to the software. Additionally, Rent Hosting reserves the right to cancel or deny service to anyone for any reason, including but not limited to the reasons below:

a. Unsolicited Bulk Email. Rent Hosting has ZERO-TOLERANCE for unsolicited email. All accounts caught spamming will be terminated, without permission to retrieve a backup of files and/or folders on the account. Should one of our reseller clients be hosting an account for a spammer, Rent Hosting reserves the right to terminate the offending account.

b. Illegal Activity. Websites making available or otherwise contributing to software piracy, hacking, spamming, denial of service attacks and/or damage to our or other networks will be terminated without notice. Free For All (FFA) link sites and IRC servers, chat applets excluded, are not allowed on the servers of Rent Hosting.

c. Adult Content. Adult content is prohibited on the servers of Rent Hosting. If adult content is found on an account, Rent Hosting will contact the owner of the account and ask him to remove the offending material. Should this not be carried out with-in three days, the company will first suspend and later delete the offending account. If a client's account contains child pornography, the offending account will be terminated without permission to retrieve a backup of files and/or folders on the account.

d. Non-Payment. If the client agreed to the monthly contract then a payment must be made every month (month is defined as the number of days in the calendar), and the client authorizes the company to charge the payment method each recurring month until cancelled. If the client signed up for a yearly account, Rent Hosting will notify him/her prior to the account expiring. If after three days the company is unable to contact a client, or the payment has not been made, the account will be suspended. A $5 re-activation fee will be charged if this occurs more than once. If after fifteen days, the client does not contact Rent Hosting or make a full payment, the company reserves the right to delete the offending account with all its information.

e. Abusive Behavior. Abusive behavior towards any of Rent Hosting staff members in any manner will not be tolerated and is grounds for account termination. Websites deemed offensive or racially inappropriate will be terminated.

f. Excessive Resource Usage. Websites or accounts using 25 percent or more of the server resources for longer than 90 seconds will be suspended without notice. Rent Hosting will contact the client thereafter and attempt to resolve the problem. If necessary, the company will ask the client to make arrangements for semi-dedicated or private servers with Rent Hosting or other companies.

6. Reseller Customers - Rent Hosting has the right to terminate and/or suspend accounts of the company's reseller clients and their customers without notice for any reason, provided our customers receive a reason for the action of Rent Hosting staff. Reseller clients may not use Rent Hosting to provie a free web hosting service.

7. Shell / SSH Access - Shell access for the client is available upon request. Reseller accounts may not give shell access to their customers. A copy of the front and back of the client's drivers license is required.

8. Services and Reliability - The client is responsible for regularly monitoring and creating backups of the client’s own files and agrees to use Rent Hosting ’s resources and infrastructure at the client’s own risk. Rent Hosting is not liable to the client or any third party for any damage, direct or incidental, that could occur as the client uses Rent Hosting’s services. Rent Hosting is also not liable for any damages downtime may bring to the client. Rent Hosting is not responsible for the delivery or quality of any goods or services sold or advertised through Rent Hosting network of web sites, its affiliates or through our client's sites. Rent Hosting does not guarantee that its security procedures will prevent the loss of, alteration of, or improper access to the client’s information.

9. Domain Name Policy - Rent Hosting will make every effort to register, transfer and/or renew client’s requested domain name. This is not a guarantee that the client's requested domain name is available for registration, transfer and/or renewal. The client’s domain name may go unregistered, untransferred and/or unrenewed, due to circumstances beyond our control, such as registry, software and other problems or outages, and will not be grounds for compensation of financial loss. The client is responsible for monitoring his/her domain expiration date and making sure to renew the domain before it expires. Rent Hosting reserves the right to use customer information, entrusted to us, during domain registration and for whois services.

a. Additional or Added Bandwidth Price: $1.00/GB
b. Additional or Added Space Price: $1.50/500 MB
c. Late Payment Fee: $5.00 Reactivation after first occurrence

11. Privacy Policy - Rent Hosting is committed to safeguarding the privacy of our customers. Rent Hosting's sole purpose in collecting personal information is to identify the client, indicate correct domain information if applicable, as well as to send recent updates and important announcements via post and/or email. This data is compiled, analyzed, and used only by Rent Hosting. The client's information is used only to send important updates regarding our services. No part of the information, the client has provided will be sold, disclosed, or made accessible by third-parties or by the public at any time.

12. Liabilities - The client is solely responsible for the conduct of the client’s business and all other matters under the client’s control. IN NO EVENT SHALL Rent Hosting BE LIABLE TO CUSTOMER OR ANY OTHER PERSON, FIRM OR ENTITY IN ANY RESPECT, INCLUDING, WITHOUT LIMITATION, FOR ANY DAMAGES, EITHER DIRECT, INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, ACTUAL, PUNITIVE, OR FOR ANY OTHER DAMAGES, OR FOR ANY LOST PROFITS OF ANY KIND OR NATURE WHATSOEVER, ARISING OUT OF MISTAKES, NEGLIGENCE, ACCIDENTS, ERRORS, OMISSIONS, INTERRUPTIONS OR DEFECT IN TRANSMISSION, OR DELAYS, INCLUDING, BUT NOT LIMITED TO, THOSE WHICH MAY BE CAUSED BY REGULATORY OR JUDICIAL AUTHORITIES ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE OBLIGATIONS OF Rent Hosting PURSUANT TO THIS AGREEMENT. Rent Hosting MAKES NO WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY, AS TO THE DESCRIPTION, QUALITY, MERCHANTABILITY, COMPLETENESS OR FITNESS FOR ANY PURPOSE FOR THE SERVICE OR LOCAL ACCESS, OR AS TO ANY OTHER MATTER, ALL OF WHICH WARRANTIES BY Rent Hosting ARE HEREBY EXCLUDED AND DISCLAIMED.

In jurisdictions not allowing the limitation or exclusion of liability for incidental or consequential damages, Rent Hosting's liability shall be limited to the extent permitted by law.
